Handling Subject Access Requests: A Guide for Organisations

Subject Access Requests (SARs) are a cornerstone of data protection regulations such as the GDPR or DPA 2018. They empower individuals to understand and control their personal data which is held by organisations. As an organisation, it's crucial to have a robust process in place to handle these requests efficiently and compliantly.

Understanding Your Obligations

When you receive a SAR, you are legally obligated to:

  • Acknowledge Receipt: Confirm receipt of the request within one week.
  • Explain Processing: Explain how the data is being processed.
  • Provide a Copy: Supply a copy of the personal data in an electronic format – given the time and cost involved in providing a paper copy this should be avoided.

As SARs are often a precursor to a complaint it is worth confirming with your PI insurer the point at which they require notification.

Key Steps in Handling a SAR

  1. Identify the Data Controller: Determine which department or individual is responsible for the data in question.
  2. Verify the Individual's Identity: Implement appropriate measures to verify the identity of the person making the request or the authority to do so if someone is making the request on behalf of another person.
  3. Locate the Relevant Data: Use your data mapping and retention policies to locate the requested information.
  4. Assess the Request: Review the request to determine the scope and complexity.
  5. Respond Timely: Aim to respond to the request within one month, unless an extension is necessary.
  6. Provide a Clear and Comprehensive Response: Present the information in a clear and understandable format.
  7. Document the Process: Maintain records of the SAR process, including correspondence, decisions, and actions taken.

Common Challenges and Best Practices

  • Data Complexity: For large and complex organisations, locating and retrieving data can be challenging. Implement effective data management practices and consider using data discovery tools.
  • Third-Party Data: If you process data on behalf of another organisation, coordinate with them to fulfil the SAR.
  • Data Security: Ensure that the personal data provided in response to the SAR is protected from unauthorized access.
  • Legal and Compliance Risks: Stay updated on data protection laws and regulations to mitigate risks.
  • Staff Training: Provide training to staff on handling SARs and data protection principles.

Tips for Efficient SAR Handling

  • In larger firms or those receiving significant numbers of requests it may be advisable to create a Dedicated SAR Team: Assign a team to handle SARs efficiently.
  • Develop Standard Operating Procedures: Establish clear guidelines for processing SARs.
  • Use Technology: Utilize data management tools to streamline the process.
  • Prioritize Requests: Identify and prioritize urgent requests.
  • Communicate Effectively: Keep the requester informed throughout the process.
  • Review and Update Procedures Regularly: Adapt your processes to evolving data protection regulations.
